Terms of Service

These Terms of Service ("Terms") govern your use of TradeHarbor, including the website at tradeharbor.co and the TradeHarbor application (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What TradeHarbor is — and isn't

TradeHarbor is a record-keeping and analytics tool for your own trading activity. It lets you log and import trades, keep a journal, track account rules, and view statistics.

TradeHarbor does not provide investment, financial, legal, or tax advice; does not recommend any security, contract, strategy, or trade; does not execute, route, or manage orders; and does not connect to or control your brokerage or prop firm accounts. Nothing in the Service is an offer or solicitation to buy or sell any financial instrument. You are solely responsible for your trading decisions.

2. Accuracy of calculations

Statistics, P&L figures, position sizes, and prop account rule tracking (including drawdown thresholds, daily loss limits, profit targets, and consistency checks) are calculated from the data you provide and the settings you choose. They may differ from your broker's or prop firm's official figures — for example, because a firm measures drawdown on intraday unrealized values, applies rules differently, or because the data you entered or imported is incomplete or incorrect. Always rely on your broker's and firm's official records and rules. TradeHarbor is not responsible for losses, failed evaluations, or account closures arising from reliance on the Service.

You own the trading data, journal entries, and other content you put into the Service ("Your Data"). You grant us a limited license to store, process, and display Your Data solely to operate and improve the Service for you. We don't sell Your Data. You can export Your Data or delete your account at any time from Settings. Our handling of personal information is described in the Privacy Policy.

5. Acceptable use

You agree not to: attempt to access other users' data or any non-public part of the Service; probe, scan, or test the Service's security without written permission; interfere with or overload the Service; use automated means to create accounts or scrape the Service; upload unlawful content or content you don't have the right to use; or resell or sublicense the Service.

6. Paid plans

Some features may require a paid subscription. Prices, billing intervals, and any trial terms are shown before you subscribe. Payments are processed by Stripe; we do not store your full card details. Subscriptions renew automatically until cancelled. You can cancel at any time from Settings → Billing, and your paid access continues until the end of the current billing period. Except where required by law, payments are non-refundable. We may change prices with advance notice before your next renewal.

7. Availability and changes

We work to keep the Service available and your data safe, but the Service may occasionally be unavailable for maintenance or reasons outside our control. We may add, change, or remove features. We'll give reasonable notice before removing a feature that materially reduces a paid plan.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. TRADING INVOLVES SUBSTANTIAL RISK OF LOSS. PAST PERFORMANCE, INCLUDING PERFORMANCE SHOWN IN THE SERVICE, IS NOT INDICATIVE OF FUTURE RESULTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEHARBOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50 IF YOU HAVE NOT PAID US.

10. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or put the Service or other users at risk. On termination, your right to use the Service ends; sections 2, 4, 8, 9, and 11 survive.

11. Changes to these Terms

We may update these Terms. If a change is material, we'll notify you by email or in the app before it takes effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
